The use of this site is governed by the policies, terms and conditions set forth below. Please read them carefully. By using this site, you agree to these terms of use. TYPOGRAPHICAL ERRORS.
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, DSVettes, L.L.C. and dsvettes.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. DSVettes, L.L.C. and dsvettes.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, DSVettes, LLC shall immediately issue a credit to your credit card.

Seller hereby expressly disclaims all warranties either expressed or implied warranty of merchantability or fitness for a particular purpose. This disclaimer by the seller in no way affects the terms of the manufacturer's warranty if any. Title to goods herein being purchased is retained by the seller until goods are paid for by the purchaser and at that time title passes to purchaser, upon receipt of goods. If goods herein being purchased are being purchased for purposes of export, purchaser must obtain from the Federal Government certain export documentation before shipping to a foreign country. In addition, manufacturers' warranties for exported goods may vary or even be null and void. If you have any questions, please inquire. Any and all liability is only for the products purchased.

Most accessories including specifically the product referenced as the "HeadLiner" are intended for use solely for showroom purposes. All of said accessories are not intended to be used for normal driving conditions or street use. Transportation laws vary from state to state. DSVettes, L.L.C. and dsvettes.com make no representation or warranty, either expressed or implied, as to the legality of its products for street use on any vehicle or in any location. Buyer agrees to indemnify and hold Sellers harmless from any claim, action or demand arising out of incident to the buyers installation or use of products purchased from Down South Vettes, LLC.
ORDER ACCEPTANCE POLICY.
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. DSVettes, L.L.C. and dsvettes.com reserves the right at any time after receipt of your order to accept or decline your order for any reason. DSVettes, L.L.C. and dsvettes.com reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $500.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order. DSVettes, L.L.C. and dsvettes.com is a reseller to end user customers and does not accept orders from car dealers, exporters, wholesalers, or other customers who intend to resell the products offered by DSVettes, L.L.C. and dsvettes.com.
SALES TAXES.
DSVettes, L.L.C. and dsvettes.com shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Texas. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.
RETURN POLICY AND SALES TERMS.
If your product becomes defective within the first thirty (30) days of the invoice date, you may return it for an exchange only. Based on the custom-made nature of the products sold by DSVettes, L.L.C. and dsvettes.com, all non-defective products are not subject to our return policy and are considered to be final sales. Non-defective products wishing to be returned will be at the sole discretion of DSVettes, L.L.C., and will subject to a 25% restocking fee. Any product known to be defective will only be sold, and can only be purchased, when both DSVettes and the buyer mutually discuss the defect and reach an accord for the transaction to transpire. Such an arrangement is final in nature and the defective product is not subject to return.
LIMITATION ON LIABILITY.
Except as otherwise required by applicable law, neither DSVettes, L.L.C. and dsvettes.com, nor its directors, employees, licensors, content providers, affiliates or other representatives will be liable for any damages whatsoever, including without limitation any direct, indirect, incidental, consequential, special and exemplary damages, arising from the use or performance of the DSVettes, L.L.C. and dsvettes.com sites or from any information, content, services or products provided through the DSVettes, L.L.C. and dsvettes.com site, even if DSVettes, L.L.C. and dsvettes.com has been advised of the possibility of such damages.
Remedy: if you are dissatisfied with the DSVettes, L.L.C. and dsvettes.com site, or any portion thereof, your exclusive remedy shall be to cease using the DSVettes, L.L.C. and dsvettes.com site. If you are dissatisfied with a product purchased through the DSVettes, L.L.C. and dsvettes.com site, your exclusive remedy shall be as set forth in our return policy.
Some U.S. states and foreign countries do not permit the exclusion or limitation of implied warranties or liability for certain categories of damages. Therefore, some or all of the limitations above may not apply to you to the extent they are prohibited or superseded by state or national provisions.

GOVERNING LAW AND VENUE.
This Agreement shall be interpreted, construed and governed by the laws of the State of Texas, USA, without reference to its laws relating to conflicts of law and not including the provisions of the 1980 United Nations Convention on Contracts for the International Sale of Goods. Venue for all disputes arising under this Agreement shall lie exclusively in the Courts of the State of Texas in Cameron County and each party agrees not to contest the personal jurisdiction of these courts. |
